If you have not obtained this software or an installation program with the same name as this software from a legally authorized third party, we cannot guarantee the normal use of the software or its security, and any losses caused will be borne by you.
3. After the new version of this software is released, the old version may not be able to be used. We do not guarantee the security, continued availability, or provision of corresponding customer service for older versions of the software. Please check and download the latest version at any time.

You promise to promptly inform us of any changes in the documents and information provided to us under this Service Agreement, and without written notice of any changes, we have the right to believe that the content of the documents and information provided by you is true, correct, not misleading, and has not changed.
5. Digital Tokens and NFT Transfer:
(1) You understand the "irrevocable" attribute based on blockchain operations. When you use Upward related functions, such as transferring digital tokens, cross-chain transferring digital tokens, transferring NFTs, etc., you should bear the consequences caused by your operational errors (including but not limited to receiving addresses, cross-chain channels, node services, etc.).
(2) You are aware that the following situations may cause the transfer function to be unavailable, the transfer to "fail" or "package timeout" when using the Upward service:
a) Insufficient wallet balance.
b) Insufficient transaction miner fees.
c) Blockchain failed to execute smart contract code.
d) Exceeding the payment limit specified by regulatory authorities, Upward, or laws and regulations.
e) Network, equipment, and other technical failures.
f) Transactions are abandoned due to blockchain network congestion, failures, and other reasons.
g) Your address or counterparty address has been identified as a special address, such as a high-risk address.
(3) You are aware that Upward only provides you with a transfer tool. After you use Upward to complete the transfer, we have fulfilled all obligations for the current service. We are not responsible for any other related disputes or controversies.

(1) We will not charge you any form of service fee or handling fee at the moment. In the future, when certain services need to be charged, we will separately agree or publish rules.
(2) You are aware that in certain circumstances (including but not limited to insufficient "miner fees" or network fees paid for the transfer during the transfer period, or unstable blockchain networks), your transfer operation may fail. In such cases, even if your transfer operation is not completed, you will still be charged miner fees by the relevant blockchain network.
(3) You are responsible for paying all taxable liabilities and other expenses incurred as a result of your transactions on Upward.

5) Risk Warning
1. You are aware that due to the incomplete laws, regulations, and policies in the field of digital tokens, there may be significant risks such as the inability to redeem and technological instability in this field. You also understand that the price fluctuations of digital tokens are much higher than those of other financial assets. We caution you to choose to hold or dispose of any type of digital token in a reasonable manner based on your financial condition and risk preference. You also understand that the market view function provided by Upward is only a search result that captures the exchange rate information of digital tokens on some exchanges and does not represent the latest market trends.
2. When using the Upward service, if you or your counterparty fail to comply with the operation prompts and rules in this Service Agreement, or related website instructions, transactions, and payment pages, we do not guarantee that the transaction will be completed smoothly, and we do not assume any liability for damages. If the aforementioned situation occurs and the digital token or NFT has already been credited to your or your counterparty's Upward wallet, you understand the "irreversible" nature of blockchain operations and the "irreversible" nature of related transactions. Consequently, you and your counterparty shall bear the corresponding risks and consequences independently.
3. When you transfer digital tokens and NFTs to other wallet addresses, you should ascertain whether the recipient is a person with full civil capacity and decide accordingly whether to proceed with the transfer during the transaction process.
4. In the process of transferring digital tokens and NFTs, should you encounter abnormal information prompts, such as "transaction failure" and "packaging timeout," it is advisable to reconfirm through the official channels of the relevant blockchain system or other blockchain query tools to prevent duplicate transfers. Should duplicate transfers occur, you will be responsible for all resulting losses and expenses.
5. You understand that when you create or import a wallet on Upward, your Keystore, private key, mnemonic, and other information are stored only on the current mobile device and not on Upward or our server. You can follow Upward's instructions to transfer your wallet to a new device through synchronization or other methods. However, if you fail to save or back up your wallet passwords, private keys, mnemonics, Keystore, and other information, and your mobile device is lost, your digital tokens and NFTs will also be lost, and we will not be able to recover them for you. Additionally, if you leak information while exporting, saving, or backing up your wallet passwords, private keys, mnemonics, Keystore, or social accounts used for third-party login, or if the device or server storing this information is compromised or controlled by hackers, your digital tokens will be lost, and we will not be able to recover them. You will bear all losses arising from these situations.
6. We recommend making a secure backup of your wallet's password, private key, mnemonic words, and Keystore when creating or importing a wallet. Avoid using electronic backup methods like screenshots, emails, notepad apps on your phone, text messages, and communication apps. Instead, it's advisable to write down your mnemonic words and Keystore information in a paper notebook. For electronic data, using a password manager is also recommended.
7. We recommend using Upward in a secure network environment and ensuring that your mobile device is not jailbroken or rooted, to mitigate potential security risks.
8. Please remain vigilant for fraudulent behavior while using Upward. Should you detect any suspicious activity, we urge you to notify us promptly.
